WHAT ARE YOUR RATES?
I’ll need a little information first, lets jump on a call! Every project is unique, and every client has different needs from a shoot. That’s why I provide a custom estimate for every project after our initial discussion, so I can understand what your needs are.

WHAT ARE YOUR TRAVEL COSTS AND EXPENSES?
Travel is calculated at 50p per mile from my base in Wiltshire, (SN12). If travelling to London, the cost will be that of a return train journey. Expenses such as parking, congestion charges and the like are charged at cost.
HOW MANY IMAGES CAN I EXPECT FROM A PHOTOSHOOT?
In a days shooting you can expect me to produce about 30 - 35 images. For a half day shoot, around 15 images.
WHO OWNS THE IMAGE COPYRIGHT
All photos are the copyrighted work of the photographer, and I retain all rights to the photos. As a client, you are provided with a License to use the photos.
You are already very used to a licensing model. When you “buy” a film through Amazon Prime, you don’t actually own the film, but rather, you own a license to watch the film on any of your personal devices for your own entertainment. Likewise, you don’t own Microsoft Word. You own a license to use the software. Photos are the same.
I include a standard usage license with every photo. This usage includes what most design businesses need each day, such as website usage, social media, design competition entries, internal uses, including proposals, printed collateral, and wall displays. I also include usage for editorial purposes. Additional usage may require additional licenses, which can be added anytime.
CAN I SHARE THE FINAL IMAGES WITH THIRD PARTIES
Third-party usage is not permitted unless properly licensed. Any other parties interested in the final photos should either enter the cost sharing agreement in advance of the shoot, or they can license individual photos directly through me after the shoot.
WHAT HAPPENS IF THE SHOOT OVERRUNS?
In the event the shoot overruns, additional hours will be charged. This will be covered in the proposal I send with my rates.
TRAVEL DAY RATE?
If the shoot is far from my base in Wiltshire and travel is required the day before or after the shoot, one half of the daily rate will be charged for each travel day.
IMAGE TURN AROUND TIME?
Please allow up to two weeks for the images.
DO I NEED TO PAY A DEPOSIT
A non-refundable deposit is to be paid at the time of booking, which will be 30% of the total cost.
The remaining amount is to be paid before the release of the edited images.
Please note the deposit is non transferable between shoots.
CAN I POST THE IMAGES TO SOCIAL MEDIA?
Of course! The photos are meant to be seen. Social media usage is included in the standard license I provide with every photoshoot. Be sure to tag me @robinqphoto
MY FULL TERMS:
1. Definitions
The following definitions shall apply in this agreement:
Appointment Date: a date (or dates) for the Photographer to attend the Location to take the Photographs, which may from time to time be agreed between the Photographer and the Client.
Charges: the charges as described in clause 4.
Daily Rate: the fee agreed upon for a working day, up to 8 hours.
Expenses: the costs incurred by the Photographer in travelling to the Location including the costs of travel and transport, accommodation and meals.
Location: a location (or locations) which may from time to time be agreed between the Photographer and the Client.
Photographs: any photographs taken by the Photographer in providing the Services to the Client.
Services: the taking of Photographs by the Photographer at the Location, including any necessary postproduction work.
Term: 10 years from the date on which the licence is granted to the Client in accordance with clause 7.1.
2. Engagement
The Client wishes to engage the Photographer to provide the Services.The Client acknowledges that the Photographer shall be the owner of the Photographs.The Photographer has agreed to grant a licence to exploit certain rights in the Photographs on the terms set out in this agreement.
3. Services
3.1. The Photographer shall provide the Services to the Client.
3.2. After performing the Services, the Photographer will make the Photographs available to the Client to view by way of the online sharing platform, Pixieset.
3.3. The Client and the Photographer may agree in writing that the Photographer shall provide further photography services to the Client on the same terms as this agreement.
4. Charges for the Services
4.1. The Client shall be charged:
(a) the Daily Rate for the performance of the Services;
(b) any Expenses; and
(c) one half of the Daily Rate for each travel day if the Photographer is required to travel to or from the Location the day before/after the Appointment Date.
(Together the Charges)
5. Payment for the Services
5.1. On booking, a 30% deposit is required to secure the Appointment Date.
5.2. After performing the Services, the Photographer will issue the Client with an invoice for the remaining Charges (Invoice).
5.3. The Client shall pay the Invoice within 14 days of the date of the Invoice.
6. Release of Photographs
After the Client has paid the Invoice in accordance with clause 5, the Photographer shall make the Photographs available to the Client to download and use in accordance with clause 7.1 (and clause 9 if applicable).
7. Use of Photographs
7.1. Subject to payment by the Client of the Invoice for the Services in accordance with clause 5, the Photographer grants the Client a non-exclusive licence to use the Photographs for the following purposes for the Term:
(a) to reproduce and use the Photographs on the Client’s websites, social media pages, emails, competition entries, portfolios, annual reports, brochures, pamphlets, or posters and whose audience is employees, customers, shareholders, or the general public.
(b) to reproduce and use the Photographs for editorial use in websites, newspapers, or magazines, in print or electronic media.
7.2. The Client does not have the right to share images with any third party or to use the Photographs beyond the use described in clause 7.1. Unless a third party has been included in the commission (such as in a cost sharing arrangement), all third party contractors, partners and suppliers are required to arrange their own licence per image after the shoot. The licence fee per image depends upon the usage requirements. The minimum fee per image is £200.00. This licence is normally provided in perpetuity.
7.3. The Photographer retains the right to sell the Photographs and the right to grant licences to use the Photographs to third parties without the consent of the Client (except where an embargo is granted in accordance with clause 10). However permission is usually sought as a courtesy from the commissioning client to avoid conflicts of interest.
8. The Client’s obligations
8.1. The Client shall not:
(a) adapt or alter the Photographs without the Photographer's prior written consent;
(b) exercise the licence in any way that is, or renders the Photographs, obscene or defamatory; and/or
(c) without the Photographer’s prior written consent amend, adapt, use or position the Photographs so as to suggest that the Photographer or any of the persons appearing in the Photograph endorse any commercial product or service.
8.2. The Client shall accord the Photographer credit on any use or reproduction of the Photographs in the form "© Photographs by Robin Quarrelle” (or @robinqphoto if the Photographs are reproduced on social media platforms such as Instagram, Facebook etc) such credit to be placed as close as possible to the parameters of the Photograph.
8.3. For the avoidance of doubt, the provisions of this clause 8 shall apply to the licence granted in accordance with clause 7.1 and any extended or amended licence granted in accordance with clause 9.
8.4. TheClient shall, except where otherwise agreed with the Photographer, be present and available to the Photographer at the Location on the Appointment Date at a time to be agreed with the Photographer. Where Services are performed on more than one Appointment Date, the Client shall be present and available to the Photographer at the Location on each day that the Services are being provided, unless otherwise agreed between the parties.
9. Extending or amending the licence
9.1. The Client may at any time during the Term request to the Photographer that the licence described in clause 7.1 be amended or extended.
9.2. The Photographer shall:
(a) have absolute discretion as to whether the licence is extended or amended; and
(b) be permitted to charge an additional fee (determined at the Photographer’s discretion) to the Client for the licence extension or amendment (Extension Fee).
9.3. If an Extension Fee is charged in accordance with clause 9.2, the Photographer shall send the Client an invoice for the Extension Fee.
9.4. Any amendment or extension in accordance with clause 9.1 shall be agreed in writing between the Photographer and the Client and such amendments or extension shall apply from the date on which the Photographer receives payment of the Extension Fee.
9.5. For the avoidance of doubt, an extension to the Term of the licence shall be deemed an extension to the licence.
10. Embargo
10.1 The Client may, within 30 days of performance of the Services, request to the Photographer that an embargo be granted over any of the Photographs.
10.2 The Photographer shall:
(a) have absolute discretion as to whether an embargo is granted;
(b) have absolute discretion as to the duration of the embargo;
(c) be permitted to charge an additional fee (determined at the Photographer’s discretion) to the Client for granting an embargo under this clause 10 (Embargo Fee).
10.3 If an Embargo Fee is charged in accordance with clause 10.2, the Photographer shall send the Client an invoice for the Embargo Fee.
10.4 Any embargo granted in accordance with clause 10.1 shall be agreed in writing between the Photographer and the Client and such embargo shall apply from the date on which the Photographer receives payment of the Embargo Fee.
11 Cancellation and postponement
11.1 A cancellation or postponement is deemed to take place where an Appointment Date (whether being one day or multiple days) is cancelled or postponed by the Client for any reason.Where such cancellation or postponement takes place, the Photographer may (at his discretion) charge a fee to the Client at the following rate:
(a) the Client shall pay all expenses incurred by the Photographer (including but not limited to travel or accommodation costs) that were intended to be used in the performance of the Services; and
(b) where there is less than 21 days but more than 7 days between the date on which cancellation or postponement occurs and the Appointment Date, the Client shall be liable to pay to the Photographer the sum equal to one half of the Daily Rate for each date which has been cancelled or postponed; or
(c) where there is less than 7 days between the date on which cancellation or postponement occurs and the Appointment Date, the Client shall be liable to pay to the Photographer the Charges for each date which has been cancelled or postponed.
12 Aesthetic and style disclaimer
12.1 The Client acknowledges that the Photographer is a professional photographer with his own unique style and that the Services are of an artistic nature, which may result in Photographs being produced which may be different to photographs produced by the Photographer in the past.
12.2 The Client shall not reject any Photographs or withhold payment for any of the Services due to the aesthetics of the Photograph's, or the Client’s personal taste leading to a disliking of the Photographs.
12.3 Where the Client has specific requirements for Photographs this should be made clear to the Photographer as early as possible and in all circumstances at least 3 days in advance of the Appointment Date.
12.4 Where the Client is not present and available at the Location on the Appointment Date in accordance with clause 8.4, the Photographer shall have complete discretion to exercise his artistic judgment in relation to the Photographs.
13 Assignment or other dealings
Without the Photographer’s prior written consent, the Client shall not assign, transfer, delegate, subcontract, or deal in any other way with any of its rights or obligations under this agreement including the rights granted under clauses 7, 9 and 10.
14 Entire agreement
This agreement constitutes the entire agreement between the parties. Each party acknowledges that in entering into this agreement it does not rely on any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in this agreement. Each party agrees that it shall have no claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in this agreement.
15 Limitation of liability and insurance
15.1 The Photographer may cancel or postpone any appointment to provide the Services at any time before an Appointment Date due to ill health or an unforeseen emergency without incurring any liability for any losses, howsoever incurred by the Client.
15.2 The Photographer confirms that he has appropriate Public Liability and Professional Indemnity Insurance.
15.3 In any circumstance the Photographer’s maximum aggregate liability for any breach or other claim arising out of this agreement shall be limited to the total amount of payment received for the Service.
15.4 Nothing in this agreement shall have the effect of excluding or limiting any liability for death or personal injury caused by negligence.
16 Governing law and jurisdiction
16.1 This agreement and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of England and Wales.
16.2 Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this agreement or its subject matter or formation.
